Here’s how I understand things. I’m not a lawyer and I’m not giving legal advice. This is just my understanding only.
1. Terms of Service (TOS) are required to remain compliant with local laws.
2. If a company (formed under local laws) doesn’t enforce the TOS, the company can come under legal scrutiny.
3. If a website forms and posts content, the TOS of the web hosting company guide them besides any other clauses they may add to their own TOS. The web hosting company must abide by local laws (since they are a company formed under law).
4. If someone operates a private server with a friendly user-interface on top of it but doesn’t enforce local law (like age limits) they can come under legal scrutiny.
📣Now, here’s where it gets complicated. 📣
👀 Perception drives concern.
📚We can only address concerns through the courts if the actions that were undertaken (or even perceived actions) meet definitions under the laws as outlined in the books for their local jurisdiction.
🕵️♀️Once a court accepts a filing of complaint or an issue, then fact-finding begins. Did what allegedly happen actually happen? Can they prove it with evidence (that again meets the court’s definition of evidence)?
⚖️ A court can hand down a decision based on the majority of evidence (that meets the court’s definition of evidence) and not full proof.
Meaning?
🔥YES -> a node can get into legal trouble for not enforcing a TOS.
🔥YES -> a website can get into legal trouble for not enforcing a TOS.
🔥YES -> if content from a blockchain appears via a node or website or server, the perception is that the content came from the same and not somewhere else, meaning YES, someone could bring the complaint into court.
🛠SOLUTION: Enforce the age limit when onboarding. Ban accounts from the node/website/server that slips through the cracks. Adopt a process for appeals in case the node/website/server banned someone by mistake. For the rest of the content, each node/website/server should provide a working functionality that allows the end-user to apply filters to sensitive or NSFW-type content at their discretion. This lets others prove that they are making a good-faith effort to not participate in potentially illegal activity. The blockchain can be scrubbed to see whether this is true on an individual basis.
💭THOUGHTS: While Web 3.0 desires to decentralize data, content, interaction, etc., it remains a fact that for now, websites, nodes, and servers must obey the laws that govern their current usage while using the internet, communicating data through servers and back-end internet service providers, financial wires, postal usage, etc. It’s not sexy, but it’s a reality.

i think since DeSo Identity carries with it a TOS that developers are agreeing to adopt, even though i don't think most people even KNOW there is a TOS in DeSo Identity, that @DESO should help us understand anything about the TOS that seems confusing.
also the fact that they don't seem to proactively attempt to enforce it kinda makes it worthless.
how does it apply to data coming into an app/site/service from another node? is the idea that every node is expected to adhere to the same basic set of rules?
if anyone implementing DeSo Identity is expected to adhere to those TOS, is there anything that we can be told about how to best do it?
i mean i don't particularly give a damn about any laws, like i've said i think COPPA should be revised, but considering that DESO is also, you know, financial in nature- i don't think the DeSo Identity TOS requirement that all users be 18+ is a bad thing. they put it there for a reason, even though they don't enforce it (and there are unclaimed celebrity accounts for celebrities under 18, i believe). i mean it's pretty common knowledge though that kids under 13 can't sign up on any social media. @pearl has this covered also, i've been able to learn from them that they're going to be doing everything necessary. can't seem to get the same info from DeSo (before you say BUT - bitclout.com, node.deso.org). but what about independent devs? is blockchain development going to be a dangerous game for indie devs? that's fine, just let's have this conversation so we all know what's up

(i removed other names from this, there are plenty of people who own creator coin for child accounts and not all of it was "received") it's probably from diamonds from way back. i don't think this is actually a problem, mind you, but i'm just curious if this is just all good.
i don't particularly like kids but i don't dislike kids either, i am not here to be some villain trying to eliminate kid profiles. maybe this is all okay, just tell me, it's all i've been asking for the last week to figure out what devs need to know about data that exists on the blockchain and how to balance the TOS against it. have the people change the bios and tell people to stop making accounts that break TOS, this isn't my job to be doing. i have cried going through this crap because some of these accounts say they want money for education and i just hope those are scammer accounts but it fucking sucks that i'm having to do this because i care about making sure i don't get in trouble and because i don't want other people to unknowingly be setting themselves up to get in trouble.
i care about @DESO. i care about myself and other devs. i care to not be on a platform that seems to be welcoming to children where they are being directly given money by adults because THIS IS THE INTERNET AND I KNOW WE HAVEN'T ALL SUDDENLY BECOME STUPID

i get down to the fact that there are child accounts, adults own creator coin for children under 13, adults are sending diamond tips to children, personal information is being stored for children
because to get answers about the TOS i guess i need to show why very clearly. i tried just sending this info to them quietly but i got the feeling they don't care😬 i even told a few people before it that if they didn't seem to take it seriously, i would imagine they're not committed long-term to the project.. so.
